The Brazilian Ministry of Finance is taking significant steps to regulate the burgeoning online betting and iGaming market. The Secretariat of Prizes and Betting has established comprehensive technical and security requirements for betting systems, sports betting platforms, and online gaming platforms used by fixed-odds betting lottery operators.
Key Regulatory Highlights:
- Data Protection Guarantee (LGPD Compliance): Operators must adhere to strict data protection protocols, ensuring user data security and privacy.
- Betting systems and data must reside in data centers within Brazil or in countries with International Judicial Cooperation Agreements with Brazil.
- Explicit user consent is required for personal data transfers, with operators providing clear information about the purpose.
- The Ministry of Finance’s technical area must have secure and unrestricted access to systems, platforms, and operational data.
- Database replication and continuous updates within Brazil are mandatory, with periodic testing to ensure data integrity.
- Operators must maintain a Business Continuity Plan for Information Technology to address critical situations that could compromise operations and data.
- Domain Registration: Electronic channels offering fixed-odds bets must utilize the “bet.br” domain, adhering to specific regulations.
- Certification Requirement: Betting systems, including sports betting and online gaming platforms, must be certified by an entity recognized by the Prizes and Betting Secretary of the Ministry of Finance, as per MF/SPA Ordinance No. 300, dated February 23, 2024.
- Valid certificates must be maintained throughout the authorization period and revalidated annually upon any critical system changes.
- New certificates must be submitted to SPA within five days of issuance.
- Data Submission: Operators are required to submit data related to bets, bettors, bettor wallets, legal destinations, and other operational information to the Secretariat of Prizes and Betting.
