How to Identify Legal Betting Sites in Peru

In Peru, online betting platforms have been regulated by the Ministry of Foreign Trade and Tourism (Mincetur) since March 2024, following Law Nº 31557. But how can you easily identify which betting sites are operating legally?

According to Apuesta Legal Perú, a specialized portal for betting sites, here are key aspects to help you recognize legal betting platforms in Peru.

Key Characteristics of Legal Betting Sites in Peru

Using Betano, the first regulated betting site in Peru, as an example, we’ll highlight three characteristics that every legal betting platform should possess:

    1. Mincetur License

Regulated betting sites include their Mincetur-issued license registration codes, typically found at the bottom of their website. For clarity, here’s how these registrations appear on Betano’s site.

    1. Responsible Gaming Disclaimer

The regulations of Peru’s Online Betting Law require all legal betting sites to include a disclaimer with the following message: “Excessive gambling and sports betting can cause gambling addiction.” This disclaimer is usually located in the website’s footer, as shown in Betano’s example.

    1. Registration on Mincetur’s Official List of Authorized Holders

Mincetur maintains a database with a comprehensive list of Authorized Holders permitted to operate in the country. This list details the legal casinos and betting sites in Peru, the companies representing these brands, their license registration numbers, and the Directoral Resolutions specifying this information.

Regulated Betting Sites in Peru During the First Year

Since the enactment of the Peruvian Betting Law in February 2024, Mincetur set a deadline for both existing and new betting sites to apply for licenses. Apuesta Legal Perú reports that over 60 betting sites, both national and international, were regulated within the first year.

In contrast to regulated betting sites, unregulated sites operate without the supervision of the Peruvian government and are not subject to national laws or taxes in Peru. Furthermore, while they often hold international licenses (such as those from Malta or Curaçao), they lack the legal backing provided by the Peruvian regulator.
